10-Year Jail Term, Rs 1 Crore Fine [New Bill for Exam Paper Leak Cheating]: The central government has presented the Public Examination (Prevent Unfair Means) Bill 2024 in the Lok Sabha on Monday 2024. It has been approved in the Lok Sabha now it is going to be presented in the Rajya Sabha after getting the approval in the Rajya Sabha Central Government will convert the bill into the act. According to the Public Examination (prevent of Unfair Means) Bill 2024, any individual or organization that is responsible for malpractices in government examinations will be penalized for a Maximum of 10 years of jail and also will be charged for a maximum of 1 crore rupees fine. However, this bill is yet to be passed in Rajya Sabha.

Public examination (Prevent of unfair means) bill 2024

The Minister of State, Sersonal, Public Governance and Pension Mr Jitendra Singh presented the public examination (prevent of unfair means) bill 2024 in the Parliament on 5 February 2024. The bill was approved in the Lok Sabha on 6 February with the majority and now it has been sent to the Rajya Sabha for approval from the members of parliament.

According to the Minister, the government does not have any specific bill To prevent cheating and malpractices. So, the bill will help to reduce cheating and malpractices and will also allow the government to punish them with the proper guidelines of public examination (prevent of unfair means) bill 2024. 

Public government examination 

The bill will cover all the examinations in India which are conducted By different agencies to recruit Central Government employees and provide admissions through entrance examinations. It will include all the examinations conducted by UPSC, SSC, IBPS, RRB, etc for recruiting employees for different posts in the Ministries.

Apart from this, the entrance examinations including NEET UG and PG, JEE, NET, CUET, And other examinations are conducted by different Institutions including the National Testing Agency NTA, CBSE, etc. So now if any authority, a person, or any organization is involved in Any type of fraud or cheating with Central Government recruitment examinations and entrance examinations then they will be punished under this act.

Cheatings cover under  public examination ( prevent unfair means) Bill

Section 3 of the Public Examination (Prevent Unfair Means) Bill 2024 has defined the meaning of unfair means for government examinations. If any individual or organization is involved in Leaking the question paper of the examination before the exam or the answer key or Helping others for cheating in the examination or Involved in stealing the question paper for the answer key before the examination then they will be punished under the sector.

Punishment for cheating in the examination 

According to section 9 of the Public Examination (Prevent Unfair Means) Bill 2024, if any organization or individual is involved in cheating in the examination then they will be imprisoned for a minimum of 3 years and it can be extended up to 5 years. It is the minimum punishment for the individual who is engaged in cheating or unfairness in the government examinations. Apart from this they also have to pay up to 10 lakh fine according to their presence in the cheating.

Punishment for cheating groups 

Apart from the individuals, there are organized groups also working to manipulate or leak the question papers before the examination. If the whole group is found in this activity, then the government will punish them strictly. So they can be jailed for up to 10 years and the government can you find them for a maximum of 1 crore rupees due to their participation in the cheating. Any organized group for institutions including the examination center or any other party will be fined and punished by the government if the government approves this bill.
