The Supreme Court of India has upheld the Delhi High Court’s judgement that directed the Central Government to restore the Old Pension Scheme (OPS) for Central Government employees. The Supreme Court in India has also asked the Central Government to apply within four weeks to explain why the OPS should not be restored. SCI has listed the matter for further hearing in February 2024. The Central Government has said that it will abide by the Supreme Court’s order and file an application within the stipulated time frame. The All India State Government Employees Federation (AISGEF) has Notified that it is optimistic that the Supreme Court will restore the OPS for all government employees.
Latest judgement on old pension scheme 2024
A bench of High Court Judges has accepted the petition of the petitioner to get the old pension scheme 2024 back and judges have also explained the importance of pensions for the Government employees. After that, the Delhi High Court ordered the state government to restore the benefits of the old pension scheme to the traditional within a month.
The state government has filed a petition against this judgement in the Supreme Court and the court has stayed the Delhi High Court judgement till February 2024 and asked relevant points from the governments of why the old pension scheme should not be provided to the Employees. However, the Delhi High Court has accepted that the state government is violating the job contract between government employees and employers (government) by providing a new pension scheme. So employees have hope to get the old pension scheme ops back before the Lok Sabha election 2024.
Notice issued to the MPs from the employees
The joint struggle steering committee has already issued notice to the MPs between 30 October to 2 November 2023 against their protest for the old pension scheme back. All India State Government employees have conducted a mega rally for restoring of old pension scheme at Delhi.
Employees are continuously protesting and conducting rallies to restore the old pension scheme for Central Government employees and all state Government employees. Employees are advocating that many states including Punjab, Rajasthan, Chhattisgarh, Jharkhand and Himachal Pradesh are already providing old pension schemes 2024 to their state employees. So, the Central government should restore the old pension scheme for the employees who are working with them.
Old pension scheme Restoration 2024
The central government approved a new pension scheme in 2004 and after that employees are getting pensions according to the provisions in the new pension scheme. Employees who get the benefit of the old pension scheme have to face loss in this scheme as the new pension scheme- NPS is based on contribution. The amount employees contribute for each month will be provided after retirement in the new pension scheme 2024.
